Artist's Receipt from the Attorney

How to Back Up Your Session Recordings Properly

A piece of paper, a signature, and that’s it? The artist’s release form determines who will own the recording later on. For producers and labels, it’s the ticket to monetizing the track; for studio musicians and guest artists, it’s often the last moment when they still have a say.

Basics

What is an artist's receipt?

The name is misleading. While an artist’s receipt does confirm that a fee was paid, its actual purpose is different: the studio musician, singer, or featured artist uses it to transfer the rights to their performance to the producer or label.

Anyone who sings, plays an instrument, or raps in the studio is legally considered a performing artist. They are entitled to their own neighboring rights, regardless of whether they wrote the song. Without their consent, the recording may not be reproduced, distributed, or streamed.

In practice, this document is also referred to as a studio musician receipt, studio musician contract, session agreement, or performer’s declaration. It always refers to the same thing: the link between the performance in the studio and the right to exploit the finished recording.

Without this bridge, it gets expensive. In case of doubt, the producer receives only the rights that were absolutely necessary for the common purpose—and years later, there can be plenty of debate about what that purpose actually was.

The contract is signed before filming begins, not after the film is released. After that, only the party that still holds the rights can negotiate.

The Legal Basis

Why Nothing Works Without a Receipt

The rights to the performance initially belong to the musician, not to the producer who paid for the studio.

§ 77 UrhG – Recording, Reproduction, and Distribution

(1) The performing artist has the exclusive right to record his or her performance on a visual or audio medium.
(2) The performing artist has the exclusive right to reproduce and distribute the visual or audio recording on which his or her performance has been recorded. Section 27 applies mutatis mutandis.

In plain language

Legally speaking, every vocal track, every guitar solo, and every featured verse initially belongs to the person who recorded it. The producer needs the rights to these elements in order to release the recording. The artist’s receipt is the way to achieve this. You can read about how the compensation for performing artists is regulated on our page regarding Section 79 of the German Copyright Act (UrhG).

Two Sides, Two Risks

Who Needs an Artist's Receipt

The same sheet of paper, but two completely different interests.

For Producers and Labels

You want to be able to use the recording without any questions asked: on all platforms, in remixes, in sync deals—even ten years from now. Any gap in the assignment is a risk that will become apparent, at the latest, when you sign a label deal, enter into a distribution agreement, or sell your catalog. Anyone who wants to transfer rights must have acquired them in full.

For studio musicians and guest artists

A form is placed in front of you, the studio is running, and everyone is waiting. At that very moment, you decide whether you’ll share in the profits of a hit, whether your name will be mentioned, and whether your voice will live on later as an AI model. A quick check beforehand costs less than an argument afterward.

What Should Be Included in an Artist's Invoice

Six key elements that distinguish a good receipt from a dangerous one.

The Parties and the Title

Who assigns the rights to whom, for which song, which production, and in what capacity? It sounds trivial, but this information is surprisingly often missing or so vague that it’s unclear later on which recording was meant.

Scope of Rights

Whether exclusive or not, limited or unlimited in time and scope, with or without the right to edit. This determines whether the producer is also allowed to remix, shorten, and use the recording in advertisements.

Compensation: Buyout or Equity Stake

A one-time fee or a percentage of the retailer’s selling price or streaming revenue. Both options are possible, and both have their pitfalls. The compensation must be reasonable; otherwise, it can be adjusted retroactively.

Attribution

Performing artists have the right to be recognized as such. The extent to which this can be limited in a receipt is a matter to be determined on a case-by-case basis and is often the main point of negotiation for guest performers.

Exclusivity and Blackout Periods

Is the musician allowed to re-record the same track for someone else at a later date? The exclusivity of the track and its duration must be explicitly stated in the receipt, as must the obligation to maintain confidentiality regarding unreleased productions.

Tax, Status, and Choice of Law

Subject to sales tax; a clear indication of freelance work rather than an employment relationship; and German law as the basis. For international sessions, the language of the contract must also be specified.

Your Artist's Receipt from a Specialist Attorney for Copyright and Media Law

Whether you're a producer in need of a reliable template or a musician who's been given a form to fill out: During a no-obligation initial consultation, we'll determine whether we can take on your case and what the consultation will cost.

The free template from the web

If you search for “artist receipt,” you’ll mostly find free PDFs. Many of them date back to a time when neither streaming nor AI existed.

Obsolete Types of Use

It includes ringtones, ringtones, WAP, and UMTS, but streaming, social media clips, and syncing with platforms are missing. Anything not explicitly mentioned is, in case of doubt, the musician's responsibility.

Not a word about AI

Neither AI training nor voice replication is regulated. For singers, this is currently the most sensitive issue of any recording session.

A buyout that doesn't last

Since the 2021 copyright reform, contributors have stronger rights to information and fair compensation. A blanket “all rights settled” clause does not provide reliable protection against this.

Wrong Country, Wrong Law

Templates from Austria or Switzerland do not necessarily comply with German copyright law. Anyone producing content here should also use a receipt that complies with German law.

We explain how to manage your rights to a recording on our page about music rights.

New Since AI

AI, Voice, and Session: The Blind Spot

Today, a vocal recording is more than just a track in a mix. It’s potential training material. From just a few minutes of clean vocals, a voice can be recreated to sing new songs that the person behind it never actually recorded.

For producers, the question is whether they are allowed to use or license the recording for AI applications. For musicians, the issue is whether they want to explicitly rule that out. Both of these points must be explicitly stated in the contract. The voice is not just a performance but also part of one’s personality, and that sets its own boundaries.

Added to this is the requirement for labeling: As of August 2, 2026, the transparency requirements of the AI Regulation will take effect. Anyone who publishes AI-generated voices must disclose this fact. Read more about this on our page on AI law and in our article on the GEMA v. Suno ruling.

Compensation

What if the recording becomes a hit?

This question rarely comes up in the studio, but it almost always comes up when the song suddenly starts playing on every playlist.

Fairness Adjustment in the Event of Success

If the agreed-upon fee is significantly out of proportion to what the producer earns from the recording, the musician may demand an additional share of the proceeds. This also applies if a buyout was agreed upon. Where the line is drawn depends on the specific case. More on reasonable compensation under Section 32 of the German Copyright Act (UrhG).

Information on the proceeds

In general, contributors may request information regarding the scope and proceeds of the use of their work. There is an important exception for studio musicians if their contribution was only secondary. It is not possible to make a blanket statement about whether a solo, a hook, or a featured verse is secondary.

A buyout covers the fee, but not every claim. The rights that the law mandates for the contributors cannot be waived in a contract.

Often forgotten

GVL and the Artists' Social Insurance Fund

Two institutions that are directly involved with the receipt and do not appear in any free template.

For Musicians: Your GVL Entitlements

If the recording is played on the radio or publicly broadcast, you, as a performing artist, are entitled to royalties through GVL—even in the case of a buyout. To report your participation, you’ll need details about the production, title, and your role. A clear receipt is the best basis for this. We explain how the GVL works in our article “What Does the GVL Actually Do?”

For Producers: The Artists' Social Security Contribution

Anyone who regularly pays fees to self-employed musicians is generally required to make contributions to the Artists’ Social Security Fund. Small labels and producer teams, in particular, tend to overlook this until an audit takes place and back payments are assessed for several years. The receipt should therefore clearly itemize the fee.

Four Steps to a Clean Session

This is how a production is run so that no one has to argue over rights afterward.

1

Clarify beforehand

Fees, profit sharing, credit, and AI usage are discussed before anyone enters the booth.

2

Sign before admission

The receipt is already filled out and ready to go; it is signed before the first track, not after the release.

3

Report Participation

The musician registers his participation with the GVL, and the producer reports the fee to the Artists' Social Security Fund.

4

Save and Share

The receipt goes into the production rights chain. Without it, things will get tricky when it comes to a label deal or catalog sales.

Frequently Asked Questions About Artist Receipts

Yes. Even someone who contributes just one verse or the hook as a featured artist is considered a performing artist and has their own rights to their performance. Without a written agreement, it’s unclear what the main artist or the label is allowed to do with that verse. In the case of features, negotiations often also cover credit, royalties, and permissions for remixes.

Legally speaking, a verbal agreement can also be valid. However, it is difficult to prove, and in case of doubt, only those rights that were absolutely necessary for the common purpose will be transferred. A written acknowledgment is required at the latest when it comes to distribution, a label deal, or filing with GVL.

If the fee is significantly out of proportion to the earnings, the musician may demand an additional share of the proceeds, even after a buyout. Whether this applies in a particular case depends on the compensation, the musician’s contribution, and the actual proceeds.

That depends on what the receipt says. Older templates do not address AI at all, which leads to considerable uncertainty on both sides. The voice is also part of one’s personality, which sets its own limits on its use. Whether the use of AI should be permitted or prohibited should therefore be expressly agreed upon.

Anyone who pays fees to self-employed musicians on more than just an occasional basis is generally required to pay this levy. This also applies to small labels and producer teams. If the levy is not paid, the Artists’ Social Security Fund may retroactively demand payment.
