Where Your Trademark Dispute Is Actually Being Heard
Not every court has jurisdiction over trademark matters—the federal states have consolidated these proceedings. In Berlin, this works to your advantage.
Short Paths Instead of Referrals
Disputes involving both German trademarks and EU trademarks are heard by the Berlin Regional Court, which also has jurisdiction over Brandenburg. This is based on § 140(2) of the German Trademark Act (MarkenG) and § 125e of the German Trademark Act (MarkenG).
It's different elsewhere
In North Rhine-Westphalia, for example, EU trademark cases must be filed centrally with the Düsseldorf Regional Court, while German trademark cases are heard by other regional courts. Anyone who files a lawsuit with the wrong court there loses time due to the transfer of the case.
For you, this means: If your opponent is based in Berlin or Brandenburg, the journey is short. We’ll still check whether another venue is worth pursuing—sometimes the case law of a particular court suggests it’s worth going the extra mile.

Frequently Asked Questions About Trademark Law in Berlin
Legally speaking, no—anyone can file an application on their own. However, mistakes are made earlier on: when determining whether the mark is even distinctive, and when selecting the classes of goods and services. Both of these issues are difficult to correct later, and a poorly drafted trademark application is often not noticed until an opposition is filed. We’ll review your mark in advance.
There are two charges: the official fees charged by the DPMA or the EUIPO, and our fee. Both depend on how many classes you need and whether you’re filing a national, EU-wide, or international application. We’ll give you a rough estimate during the initial consultation before you commit to anything.
Don’t sign anything, and make a note of the deadline. A pre-drafted cease-and-desist letter is almost always too broad and binds you for years, complete with a contractual penalty. We’ll check whether the claim is valid at all, whether the amount of the costs is justified, and whether a modified declaration is the better course of action. That depends on your market. If you sell only in Germany, a national trademark is sufficient. As soon as you start shipping throughout Europe or selling on international platforms, the EU trademark is usually the better choice—it’s valid in all member states, but it’s also more vulnerable because a single prior right anywhere in the EU can invalidate it. We’ll discuss this trade-off in detail based on your specific situation.
It usually takes several months from the filing of the application to registration; expedited examination is available for an additional fee. Important to know: Protection takes effect retroactively from the filing date, not just from the date of registration. After registration, there is also an opposition period during which holders of prior rights can file an opposition.
In Berlin, both types of proceedings are handled by the Berlin Regional Court: disputes involving German trademarks as well as EU trademarks, including those for Brandenburg. This is an advantage over countries where jurisdiction is divided among different regional courts. We also represent you before all German courts, as well as before the DPMA and the EUIPO.
